Advertising Rules

The Listing Rules for all categories listed below apply to both individual and Business Account holders. These rules form part of the www.elanbaz.az website and mobile application user agreement. Users are deemed to have accepted and undertaken to comply with the rules set out in the user agreement, and not to include statements that could mislead consumers in accordance with legislation, especially in advertising forms.

Contact details entered by the user who placed the advertisement may only be used to obtain information about the advertisement and for communication purposes.

Personal data of the advertiser or third parties protected by law on the protection of personal data, or special personal data that may be included in the advertisement, may not be used, copied, published in the media, processed or disseminated for other purposes. They may not be made available or provided for use to external parties for other purposes.

Under the privacy principle, no person's sensitive personal data shall be included in advertising information or photographs related to the advertisement.

Users must read the current list of prohibited products. This list may be updated and its content changed.

Citizens of the Republic of Azerbaijan living within and outside Azerbaijan may use all services within the scope of the user agreement (provided the product is only within the country's territory).

Citizens of foreign countries may use only one (non-prohibited) part of the services within the scope of the user agreement.

If the clearly stated rules and User Agreement are violated, payment for paid listings removed or directly deleted by the administration will not be refunded. Users accept that they assume responsibility in this regard and will not claim any right from www.elanbaz.az.

Listings deemed appropriate are reviewed again by the site administrator after automatic acceptance by the system; listings then deemed acceptable are published on the site for the period determined by the site management (30 days).

The user may renew the listing free of charge within the next 30 days from the time of placing the listing.

Users should know that the publication period of edited listings is not extended.

If 30 days have passed since the listing was placed, free renewal of that listing is not possible. The user must renew the next listing in the category using paid services.

www.elanbaz.az reserves the right to reject and remove from the site those listings where a rule violation is found upon re-checking.

Those who publish rental listings for tourism purposes are obliged to operate in accordance with the applicable legal legislation and the rules for publishing advertisements on the portal.

Only those users who publish rental listings for tourism purposes without fulfilling their legal obligations will be liable for administrative sanctions and fines applied against them.

Users must verify their identity through the system (log in) in accordance with legal rules before placing a listing, editing a listing, or re-publishing a listing.

Personal or business account holders accept that they will not be able to place listings in accordance with the relevant legislation if they do not carry out the personal cabinet login process.

If duplicate listings entered have identical characteristics, the first listing entered shall be kept and the second, duplicate listing shall be deleted from the system.

Account holders who repeatedly re-enter the system after deletion of an advertisement may have their advertisements deleted and their accounts temporarily suspended or cancelled.

Premium service operation: The period for premium listings to be published in the top positions on the site as premium is the number of days indicated (the listing's total activity period is 30 days).

The user may purchase premium again for 1 listing as many times as desired. Premium listings with the highest number of days remain in 1st place on the main page until the end of the service's activity period.

21. Rules for placing listings

Real Estate

The listing title and listing description section must contain only information related to real estate. Product links must not be added in the advertisement title and listing description sections.

Photos added must not contain company logos, phone numbers or links, logos or names of various websites. In photos marked as selected showcase image: Company logos, phone numbers, website links, coloured backgrounds, coloured frames, text content, images used in programmes must not be included.

Photos of a different user must not be used within the system.

Separate listings must be placed for sale of property and for rental. It is prohibited to include both sale and rental information in the same listing.

Separate listings must be entered for real estate with the same characteristics located in the same block or at the same address. A second advertisement entry with the same characteristics is considered a duplicate.

Different photos must be used for each listing; the same photo must not be used in a second advertisement even if in the same place.

Real estate listing entries must be made by the owner or with the owner's consent. This responsibility belongs to the user. Users' listings may be deleted and their accounts temporarily suspended or cancelled in accordance with the property owner's objection.

In your apartment listings that you wish to sell with debt, the total amount including all debts must be entered in the price field.

Website, email address and company contact details must not be included in the advertisement description sections. Phone number and username must only be published in the user information section. Only words relevant to the category must be used in the advertisement title.

Sold or rented products may not be re-published as "Sold", "Rented".

Advertisements containing statements that may create the impression that the sale process is ongoing or may create the possibility of misleading or confusing the consumer will not be published and current listings will be removed from publication.

Within the system, listings regarding real estate owned by banks may only be placed by persons authorised in that regard.

Information on listings published by the user may not be changed later by the advertiser and the advertiser accepts in advance that they will not object to this matter. Those listings may be edited if an error is found in the stated text.

Users who are citizens of foreign countries may publish listings in this category.

Vehicles

Only information about that vehicle must be included in the listing title and listing description section. Advertisement content must be written in the advertisement title and listing description section; links must not be added.

Photos used in listings to be published must belong to that vehicle and must be taken within the territory of the Republic of Azerbaijan.

Correct information must be entered for the criteria (price, km, model, year, etc.) shown in the listing specifications. Responsibility for the accuracy of this information lies with the advertiser.

Selection of the category, brand and model of the vehicle entered is the user's responsibility and if the advertisement is rejected for incorrect selection, the advertisement right is lost and a new right arises only on a paid basis.

Separate listings must be entered for vehicles with both sale and rental content.

Advertisements may only be placed for the sale of vehicles that belong to you.

Pre-order listings are prohibited.

Separate advertisements must be placed for different vehicles of the same brand and model.

It is prohibited to publish listings about vehicles to be ordered from foreign countries.

Users who are citizens of foreign countries may only publish listings for "rental" cars in this category.

Items

Only product information must be in the advertisement title and listing description section. Advertisement content must be written; links must not be added.

Advertisement of products on the prohibited products list may not be conducted.

Photos used in listings to be published must belong to the product being sold.

Correct information must be entered for the criteria shown in the advertisement specifications.

Citizens of foreign countries may not publish listings in this category.

For home and garden

Only personal information must be included in the advertisement title and description section. Advertisement content must be written; links must not be added.

The photo used in advertisements to be published must belong to that person or be appropriate to that area.

Citizens of foreign countries may not publish listings in this category.

Job listings

Only job-related information must be included in the listing title and description section. Advertisement content must be written; links must not be added.

Job vacancy listings must only be published by offices, companies or entrepreneurs existing within the Republic of Azerbaijan. Placing listings related to vacancies in foreign states is prohibited.

Responsibility for the presence of listings related to vacancies in foreign states on the portal lies directly with the users who publish those listings. www.elanbaz.az is not responsible for those listings.

Citizens of foreign countries may not publish listings in this category.

Children's world

Only information about the worker must be included in the listing title and description section.

Listings about job seekers must only be published by users within the Republic of Azerbaijan.

Citizens of foreign countries may not publish listings in this category.

Services

Only information about the service or person must be included in the listing title and description section.

Citizens of foreign countries may not publish listings in this category.

Animals and products

Only information about the relevant animal or product must be provided in the advertisement title and description section.

Business account holders may not place advertisements about animals.

In the "Agricultural products" subcategory, placing a listing for the sale of any food product is prohibited except for products that can be sold wholesale, only by entrepreneurs operating as farmers. Citizens of foreign countries may not publish listings in this category.

Electronics

Only information about that device or product must be included in the listing title and description section.

Citizens of foreign countries may not publish listings in this category.

Business Pages

Business account users may only publish listings about products appropriate to their type of activity through the account they have opened.

Business users must not display their web pages and email addresses for promotional purposes.

Azerbaijani citizens living abroad may only open a business account for the purpose of publishing bulk listings about products located in Azerbaijan territory. Otherwise it is prohibited and all opened accounts will be deleted and the paid package amount will not be refunded.

Citizens of foreign countries may only publish listings in the "REAL ESTATE" and "Rental" cars categories by opening a business account. They are not permitted to publish listings in other categories.

22. Changes to the Rules

www.elanbaz.az may update and amend the provisions of the Rules at any time by publishing them on the portal. Updates and changes to the Rules enter into force as of the date of publication on the Portal.

23. List of prohibited products and listing types

Organs, products and devices harmful to human health, energy drinks, food supplements, food products, cultural and natural heritage, sale of firearms and cutting tools, flammable, explosive devices and materials, official clothing and military equipment, credit cards, credit product sales advertising, gold jewellery and valuable items obtained by pawnshops, politically themed products, pharmaceutical preparations, sale of second-hand clothing (especially underwear), sale of concert and event tickets, betting, lottery tickets, alcoholic beverages and tobacco products, document sales, prohibited animal species, virtual currency sales, listening devices, all kinds of narcotic substances, stolen goods, unregistered electronic devices, personal information related to marriage, sexually themed products and content, etc.

It is strictly prohibited to prepare listings about all types of products whose sale, use, application, carrying, storage, or distribution is prohibited by law. Users who prepare such listings are personally responsible for their actions.
