User Agreement

This agreement consisting of two annexes is between you (the user) and www.elanbaz.az regarding your registration or use of the www.elanbaz.az website and mobile application. The user will confirm that they have accepted this agreement of their own consent at the stage of registering on the www.elanbaz.az website and mobile application. All users are deemed to have the right to make a free and voluntary decision in accepting the agreement! The agreement covers all products and services available on the website and mobile application. By using the services available on the platform you are deemed to have confirmed that you are over 18 years of age and to have assumed all responsibility regarding the rules.

Users accept that the User Agreement and the annexes published within it are an integral part of the agreement, that they have read and understood their content, and declare that they will act in accordance with those rules.

3. Subject and scope of the User Agreement

The subject of the User Agreement is the determination of the services offered on the portal, the conditions for benefiting from these services, and the rights and obligations of the parties. All warnings, notices and declarations made regarding the User Agreement and its annexes are within the scope of the agreement.

By accepting the provisions of the User Agreement, the user accepts all rules and conditions set by www.elanbaz.az on the portal and undertakes to act in accordance with them.

4. Definitions

System: The website or mobile application through which www.elanbaz.az offers its services.

User: Any natural or legal person who accesses the portal.

General provisions

5. Personal data

All kinds of data relating to users themselves mean the special personal data listed.

The data or set of data that the user independently provides about themselves when accessing the site or using it, including personal data automatically transmitted to the administration during the user's use of the site, and other user data.

6. Personal cabinet

The rights and obligations of the personal cabinet holder are rights and obligations belonging to the applicant that cannot be transferred in full or in part to any third party.

A user who wishes to create a personal cabinet may not have the right and authority to be an account holder until account operations are completed after filling in the registration form.

The application for creation of a personal cabinet may be rejected by www.elanbaz.az without giving any reason or additional conditions may be requested. www.elanbaz.az may block or completely delete the user's personal cabinet when it deems necessary.

As a result of the user confirming electronically that they have understood and accepted the user agreement, in addition to the user agreement on the portal, they are also deemed to have accepted annexes such as "rules", "privacy" etc. which form part of the agreement.

The user may create a personal cabinet by performing the operations required to benefit from the services offered on the portal. They can view their information here through the personal cabinet.

Information and reports regarding services and the personal cabinet designated by the user with their username and password are used only by themselves.

The personal cabinet is linked to the business account and the user should know that in case of any rule violation that may arise on their part, their personal cabinet may be blocked or cancelled together with their business account. Amounts previously paid for packages for listings deleted due to rule violations are not refunded.

7. Personal cabinet conditions

The user must have reached the age of majority to have a personal cabinet.

www.elanbaz.az may unilaterally cancel this agreement at any time without any justification or notice, and may close or permanently delete the user's personal cabinet without bearing any other responsibility.

Cases of violation of the stated rules, cases where the user poses a risk to the information security system, are among the cases of account closure or temporary suspension of the account.

8. Services

The opportunities offered by www.elanbaz.az so that users can perform the tasks and operations set out in the user agreement on the portal.

Citizens of the Republic of Azerbaijan living within and outside Azerbaijan may use all services within the scope of the user agreement (provided the product is only within the country's territory).

Citizens of foreign countries may use only one (non-prohibited) part of the services within the scope of the user agreement.

www.elanbaz.az may make changes or adaptations to the services offered on the portal at any time. Information regarding changes or adaptations is published in the user agreement and enters into force as of the date accepted by users.

9. Business account

A service that ensures bulk display of listings on accounts to be created freely by the user. Payment is determined by www.elanbaz.az.

Each of the stated rules also applies to Business accounts.

One of the paid packages must be obtained to place listings on behalf of the business account. Package activity period is 30 days.

Users who place listings on behalf of the business account may only place listings on their pages that are appropriate to the field of activity they are registered in.

Azerbaijani citizens living abroad may only open a business account for the purpose of publishing bulk listings about products located in Azerbaijan territory. Otherwise it is prohibited and all opened accounts will be deleted; if any package has been purchased within the account the amount paid will not be refunded.

Citizens of foreign countries may only publish listings in the "real estate" and "Vehicles" categories by opening a business account. Users from those citizens are not permitted to publish listings in other categories through their business account and all accounts opened for that purpose will be deleted; if any package has been purchased within the account the amount paid will not be refunded.

If the rules are violated again despite the warning, listings will be removed from the site even if paid. In this case the money paid is not refunded.

The relevant section of the Rules explains in detail the use of business account services. Those account holders are obliged to comply with the stated conditions.

10. Paid services

Premium listing

Premium 7 days / 7 AZN
Premium 14 days / 14 AZN
Premium 30 days / 30 AZN

The service price does not depend on the listing category.

How does the Premium service work?

The period for premium listings to be published in the top positions on the site as premium is the number of days indicated above (the listing's total activity period is 30 days).

Note: The user may purchase premium again for 1 listing as many times as desired.

Premium listings with the highest number of days remain in 1st place on the main page until the end of the service's activity period.

Every second listing published regardless of category

Regardless of category, each user has the right to place only 1 free listing per top category.

The price of every second listing that users publish on the site is 1 AZN. (Premium status is not given to those listings.) Total active period is 30 days.

Packages

Packages consist of economical services prepared for business account users.

The current packages offered when business users place listings are as follows.

10 listings / 8 AZN
15 listings / 12 AZN
30 listings / 26 AZN
50 listings / 45 AZN

The usage period of each package is 30 days.

The amount indicated within the packages is only the service fee.

Listings placed using any package obtained do not carry premium status.

11. User rights and obligations

Citizens of the Republic of Azerbaijan living within and outside Azerbaijan may use all services within the scope of the user agreement; citizens of foreign countries may use only one (non-prohibited) part of those services.

The user accepts and undertakes all responsibility that they will act in accordance with the rules, declarations and all applicable legislation shown on the portal, that they have understood and confirmed the provisions of the agreement and the annexes considered part of it.

www.elanbaz.az has the authority to submit the user's confidential, personal and commercial information to www.elanbaz.az and to official bodies to whom it is obliged to give explanation if necessary.

The user accepts that they will not claim compensation from www.elanbaz.az due to information submitted by www.elanbaz.az to official bodies in accordance with the provisions of the applicable legislation and undertakes all responsibility.

The user accepts and agrees that the information and content they submit on the portal is correct and legal, that the publication of such information and content on the portal or the sale and display of related products is legal. www.elanbaz.az does not have the obligation or responsibility to investigate the accuracy of the information and content uploaded by the user. www.elanbaz.az does not bear responsibility for any damage caused to the user as a result of the user's information and content being published inaccurately or incorrectly on the portal.

The user is responsible for ensuring the security of the username and password used to access their personal account and must keep them from third parties. The user bears responsibility for any material or moral damage that may be caused to them due to their own negligence.

The user may not transfer the User Agreement or its rights and obligations to any third party in part or in full without the written consent of www.elanbaz.az.

The user may perform operations on the portal for purposes in accordance with the rules. The user bears legal and criminal responsibility for each operation and action they perform on the portal.

The user accepts that they will not reproduce, copy, distribute, process, transfer or upload information that could result in violation of the personal rights of the user or other third parties on the portal, such as images, texts, files, databases, catalogues and lists, and will not engage in any commercial activity with such actions, and will not participate in such actions or unfair competition behaviour or operations.

www.elanbaz.az does not bear any responsibility for any damage caused or that may be caused to third parties due to activities performed on the portal by the user in violation of the provisions.

www.elanbaz.az allows the user to use the listings to view the listings and to learn only the content and current status of the relevant advertisements in the personal cabinet, and does not allow access to a certain number or all of the advertisements for any other purpose.

www.elanbaz.az does not allow the partial or full copying of information through the database, publication in other media, compilation, processing, transfer to other databases, or making it accessible and usable by third parties.

www.elanbaz.az does not bear any responsibility for defects in goods and services received by the user from third parties.

The user declares that the related obligations belong to the seller and accepts that www.elanbaz.az is exempt from responsibility.

When the information submitted at the registration stage changes, the user is obliged to inform www.elanbaz.az without delay about the new and updated information. www.elanbaz.az does not bear responsibility for all damages that may be caused to the user if the user does not inform.

It is strictly prohibited for the user or other persons to take any action that could threaten the security of the system or harm other users, or to take any action that could obstruct other software belonging to the system, or to apply disproportionate load to the system in a way that could cause these results from working or other users' attempts to benefit from the portal, to access the source codes or www.elanbaz.az systems without authorisation, to copy, delete, modify this information or to attempt to do so, to use or attempt to use software that would obstruct the operation of the portal, any software, equipment or servers to disrupt their operation, cause their malfunction, organise attacks, seize them or interfere in another way or to attempt to gain access to www.elanbaz.az servers; and any person or persons who do or attempt to do any of the above bear responsibility for those actions.

Users are recommended to approach listings published in prohibited categories by citizens of foreign countries with particular attention and to attach importance to them only after being sure of their accuracy. Users personally bear and accept responsibility for any negative situation they may face due to such listings being well-founded or unfounded, and for any material or moral damage caused to them due to listings that do not reflect accuracy and that are published for fraud purposes. Users accept that they will not claim any right from www.elanbaz.az for any damage caused to them.

12. www.elanbaz.az rights and obligations

www.elanbaz.az undertakes to fulfil the stated conditions regarding the provision of the relevant services set out in the User Agreement and the explanations set out in the annexes to the User Agreement, and to create the infrastructure necessary for the provision of those services. The obligation to create the infrastructure set out within the User Agreement does not mean unlimited and full service obligation. www.elanbaz.az may suspend or cancel the services and infrastructure set out in the User agreement at any time without any notice. www.elanbaz.az has the right to change the services and content offered on the portal at any time.

It reserves the right to deny access to the user and third parties, including system users, and to retain the information and content uploaded to the system. Changes or corrections may be made when necessary without any notice. All damages, legal and criminal responsibilities that may arise due to users not fulfilling in time the changes or correction requests required by www.elanbaz.az are entirely the responsibility of the users.

Links may be provided through the portal to other websites or portals, files or content owned and operated by sellers, providers and other third parties. www.elanbaz.az does not bear any responsibility for the files and content, services or products offered through the portals or websites obtained through these links.

www.elanbaz.az may delete content that is contrary to the operation of the system, law, legislation, the rights of other persons, the conditions of the User Agreement, the protection of personal data and the rules. It may cancel the user's account without any notice if the user includes content contrary to general morality. It may impose additional obligations on the user depending on changes in legislation and these obligations enter into force as of the date of publication on the portal.

www.elanbaz.az and its employees do not bear responsibility for the compliance of the content submitted by users on the portal with legislation, its authenticity and accuracy.

It does not guarantee that certain results will be obtained as a result of the performance of the agreement. No representation or warranty is given regarding the infringement of intellectual property rights, the accuracy of the advertising content, or the use of the portal.

Furthermore it does not bear any responsibility for the failure to deliver services under the agreement on time, suspension, including due to technical maintenance work, technical malfunctions or any other reason.

It presents the services as they are and does not undertake any obligation that the services will be error-free, flawless, uninterrupted, perfect or that they will meet the user's special needs. It may make any changes, updates and similar work on the portal and the user is deemed to have accepted them as they are as long as they continue to use the services.

www.elanbaz.az does not bear responsibility for malfunctions arising from all equipment, system software, other software and network, internet connection, connection errors, any changes, updates and similar work to be carried out, errors and malfunctions that may occur, power cuts, viruses and similar factors.

When it is determined that the information submitted by the user is insufficient, inaccurate or not current or is misleading and harmful, that the applicant's application was previously rejected, that there are complaints or negative situations, those accounts may be completely blocked.

When there are negative situations, complaints and similar reasons regarding the user during the period of use, www.elanbaz.az may cancel this agreement and close the user's account without any notice or compensation obligation. It may take the measures it deems appropriate for the necessary checks to be carried out by the system officials before closing the account.

After the account is closed, temporarily suspended or the agreement is terminated for any reason, www.elanbaz.az has the authority to decide on the fate of the content or other information shared by the user.

13. Intellectual property rights

The trade name, trade mark, logo, service marks and generally used design and codes used on the site and mobile application belong to "www.elanbaz.az" and it is prohibited for that information to be copied, distributed, appropriated, used for other purposes, transferred by www.elanbaz.az portal users and other persons, or to commit acts that disrupt or slow down the operation of the system and the like. www.elanbaz.az has the authority to resolve any disputes and rule violations arising from the commission of any of the above acts by the stated persons through local courts, and the suspected person or persons will be subject to criminal liability under the law.

There are no trade names, trade marks, service marks and logos on the platform that do not belong to us. The existing names and marks belong to us.

It is prohibited for external persons to use any software that does not belong to us in a way that could cause confusion with our trade names, trade marks, service marks or logos in similar and other services in different fields.

External persons do not have the right to use any trade name, trade mark or logo in the system.

All data and elements on the site in accordance with the law have been obtained by www.elanbaz.az from third parties on a licence basis.

Except in cases expressly permitted by the management within the framework of the conditions, it is prohibited to use, distribute, display or permit the use of others' services in accordance with one's own intellectual rights and copyrights.

www.elanbaz.az reserves the right to use the portal for the purpose of benefiting within the framework of the conditions with the conclusion of the User Agreement.

14. Campaigns and offers

You are recommended not to comply if you are not sure that the campaigns and offers on the www.elanbaz.az website and mobile application are published only by www.elanbaz.az and if you have doubts that there is no accurate information.

Make sure that the links given on the www.elanbaz.az site and mobile application belong to the portal before clicking on them.

www.elanbaz.az does not bear any responsibility for any damage caused to you as a result of your accepting information that does not reflect accuracy on the portal.

15. List of prohibited products and listing types

Organ, products and devices harmful to human health, energy drinks, food supplements, food products, cultural and natural heritage, sale of firearms and cutting tools, flammable, explosive devices and materials, official clothing and military equipment, credit cards, credit product sales advertising, gold jewellery and valuable items obtained by pawnshops, politically themed products, pharmaceutical preparations, sale of second-hand clothing (especially underwear), sale of concert and event tickets, betting, lottery tickets, alcoholic beverages and tobacco products, document sales, prohibited animal species, virtual currency sales, listening devices, all kinds of narcotic substances, stolen goods, unregistered electronic devices, personal information related to marriage, sexually themed products and content, etc.

It is strictly prohibited to prepare listings about all types of products whose sale, use, application, carrying, storage or distribution is prohibited by law. Users who prepare such listings are personally responsible for their actions.

16. Law

The invalidity, illegality or non-application of any provision of the agreement, together with the annexes that form part of that agreement as set out in the User Agreement, will not affect the validity of the remaining provisions of the agreement.

www.elanbaz.az has the authority to resolve any disputes and rule violations that arise through local courts.

17. Technical support

Each user may send their request to the www.elanbaz.az site through the "Contact us" section. The subject you request must be clear and understandable.

The personal data in the application must match the data you used during registration!

Your request may not be answered by the management if the content of the subject you request does not have the same characteristics as any of the data mentioned above!

Requests included in the application are finalised free of charge within 30 (thirty) days at the latest (when there is no cost), in accordance with the nature of the request, and you are informed of the result.

18. Force majeure

Natural disasters, wars, conflicts, strikes, communication problems, internet outages, system-related improvement or update work and malfunctions that may occur in this regard, power cuts and the like are accepted as force majeure where the management cannot prevent them despite taking the necessary measures. www.elanbaz.az does not bear responsibility for the late or incomplete performance or non-performance of any of its actions set out in the user agreement in all cases considered force majeure by law. Compensation cannot be claimed from www.elanbaz.az for delay, incomplete performance or non-performance in such cases.

User Agreement changes

www.elanbaz.az may change the User Agreement at any time it deems appropriate by publishing it on the portal.

The amended provisions of the User Agreement will enter into force as of the date of publication on the site and the remaining provisions will continue to retain their provisions and consequences.

19. Annex-1 Privacy Policy

One of the annexes to the User Agreement is the Privacy Policy in Annex 2.

The content of the Privacy Policy is related to the use of the www.elanbaz.az website. The definitions in the Rules and User Agreement will be taken into account in the interpretation of expressions not defined in the Privacy Policy. Users are deemed to have accepted this Privacy Policy after accepting the Account Agreement.

Confidential information may only be disclosed or used to third parties within the conditions set out in the Privacy Policy.

The user declares, accepts and undertakes responsibility for sharing their phone number with persons acting as buyer for the purpose of ensuring contact between Seller and Buyer regarding the listing.

The use of information such as name, surname, phone number, email address required at the stage of having a personal cabinet for purposes outside the purpose and scope determined by the agreement is prohibited.

Personal data may also be transferred to companies that www.elanbaz.az cooperates with for the purpose of conducting research for the improvement of their processes in accordance with the intended conditions and with additional confirmations and explicit consents when necessary.

The user's information consisting of personal data entered on the portal is collected and processed by us within the framework of the User Agreement for the purpose of providing User functions. It will be used to provide the services listed above. Detailed information on the Protection of Personal Data is set out in the annex.

The data protection policy and any change regarding other personal data enter into force from that day when made. The user must definitely read the agreement before accepting it in order to be aware of this change and must then accept it. The user is obliged to comply with this and cannot claim any right from www.elanbaz.az for any damage or harm caused in connection with these changes.

Users or third parties will be held responsible by the administrative authorities when they act in a way that is contrary to the data protection obligation, when it is transferred or when personal data is processed by other methods and this use causes a violation. They accept that they will pay the equivalent of this damage in cash upon first request in any damage regarding personal data in legal proceedings.

All domestic laws will apply to all legal issues that will be applied and may arise.

The user accepts that www.elanbaz.az has no responsibility for any negative situations that may arise from the processing of the user's personal data by the data controller who operates other search systems or indexing systems.

Changes to the Privacy Policy

www.elanbaz.az may update and amend the provisions of the Privacy Policy at any time by publishing them on the portal. Updates and changes to the Privacy Policy enter into force as of the date of publication on the Portal.

Users accept that they must review the privacy policy from time to time during their use in order to be aware of the changes to the information set out in this privacy policy.

20. Annex-2 Rules

The content of the Rules is related to the use of the www.elanbaz.az website. The definitions in the Privacy Policy and User Agreement will be taken into account in the interpretation of expressions not defined in the Rules. Users are deemed to have accepted these Rules after accepting the User Agreement. Users accept that they must review the Rules from time to time during their use in order to be aware of the changes to the information set out in these Rules.

Changes to the Rules

www.elanbaz.az may update and amend the provisions of the Rules at any time by publishing them on the Portal. Updates and changes to the Rules enter into force as of the date of publication on the Portal.

YOU PERSONALLY BEAR RESPONSIBILITY FOR PAYMENTS (BEH) YOU MAKE IN LARGE OR SMALL AMOUNTS WITHOUT SEEING THE PRODUCT REGARDLESS OF CATEGORY, WITHOUT BEING SURE OF ITS EXISTENCE!
